Customers from abroad or foreign governments frequently request certifications from American companies exporting goods covered by the Federal Food, Drug, and Cosmetic Act (FD&C Act).
The Food and Drug Administration can provide certificates, such as a digital Certificate to Free Sale (FDA). This document guarantees that the documents indicated are on file with the Department of Health and Human Services and the Food and Drug Administration.
If a food satisfies the requirements of FD&C Act section 801(e) [21 U.S.C. 381(e)], it may be exported. A food that is intended for export is not considered to be adulterated or misbranded under the FD&C Act if it meets the following criteria:
- it meets the requirements of the foreign buyer;
- it complies with local laws;
- it is marked on the outside of the shipping package that it is intended for export; and
- it is not sold or offered for sale in domestic commerce.
Document issued by the Department of Health and Human Services FDA division can be apostilled through our San Francisco and Atlanta offices. The U.S. Department of State's Office of Authentications receives documents that have been delivered to our offices the following business morning. Additionally, we provide free overnight return shipping via FedEx or UPS.
